TERMS AND CONDITIONS OF ORDERING

Orders

• Fulfillment of orders by Oxygen Technologies and Products Pty Ltd and/ or third parties is subject to availability of stock.
• If we cannot supply the exact item that you have ordered, you may cancel your order.
• Submission of your order via the on-line Order Form constitutes an irrevocable offer to buy the items ordered from Oxygen Technologies and Products Pty Ltd at the advertised price, plus all applicable delivery charges.
• Acceptance of your order is subject to our terms and conditions of sale and shall be notified to you via email.
• No order shall be considered final until paid in full.

Delivery

• We will advise delivery method and delivery charges prior to shipping.
• Delivery charges must be paid at the time of confirmation of shipping.

Payment

• Your order total (including delivery charges) must be paid prior to shipping.
• We will not charge your credit card, nor bank funds, until your order (including delivery method and charge) is confirmed.
• We accept payment by bankers draft, money order or credit card.
• If you pay using a credit card, an additional 1% will be added to your order total to reimburse us bank fees incurred.

Title

• Title shall not pass to you until your order is paid in full
• Title and risk in the goods shall pass to you as soon as we ship the goods to you.
• You must arrange appropriate insurance cover for the goods from time of shipping.
• Advice to you of an expected delivery date is an estimated date of delivery only. We shall not be liable for delays in delivery by manufacturer(s), shipping firms, and/ or clearance of customs, and any delay in delivery shall not entitle you to a refund.
• If you cancel your order after confirmation, no refund is available.

Miscellaneous

• We will supply you with Instructions for Use of our equipment. You must follow these instructions - we will not be responsible for any loss or damage (whether pecuniary or otherwise) if you fail to follow our instructions.
• Goods of Oxygen Technologies and Products Pty Ltd and/or third parties sold by Oxygen Technologies and Products Pty Ltd are intended for recreational use only and are not intended to diagnose, prevent, monitor, treat, cure or alleviate any disease or injury.
• No therapeutic or health claims are made or should be made for any of the equipment or products.
• Goods of Oxygen Technologies and Products Pty Ltd are intended for commercial use only, unless otherwise expressly stated.
• Oxygen Technologies and Products Pty Ltd warrants the goods included in your order to be of merchantable quality and are warranted by the manufacturer. No warranties as to fitness for any purpose, application, or use, or any other warranties, expressed or implied, have been made or shall apply, save as required by the Trade Practices Act 1974 .
• You agree not to deal with or contact any equipment, product and/ or supply sources(s) of Oxygen Technologies and Products Pty Ltd, or in any way, attempt to circumvent Oxygen Technologies and Products Pty Ltd without our express written permission. You agree not to mix the products or appliances, equipment or supplies of Oxygen Technologies and Products Pty Ltd with those provided by any other source. You agree not to share any of the proprietary or confidential information of Oxygen Technologies and Products Pty Ltd to competitors and non-customers alike.
• Oxygen Technologies and Products Pty Ltd, its employees and agents will not be liable for any loss (whether pecuniary or otherwise) arising directly or indirectly from our supply to you of equipment or otherwise.
• Your privacy and its protection are important to us. We handle information collected in accordance with the National Privacy Principles ~ view our privacy policy.
